  • Melanesian Spearhead Group Resolution July 2009

    On July 7 last year we had outlined the only lawful resolution that the Melanesian Spearhead Group could have passed, like everything else in the Pacific, it took 12 months for the ONLY POLICY ADVICE to be understood and applied. So here it is again. An organization is bound by its Founding Document, its Constitution. People and States that respect the Rule of Law work within these boundaries, they do not Abrogate nor Derogate when convenient like our criminal military mob in Fiji and his coup apologist. 


    The Melanesian Spearhead Group is a sub-regional organization which was established for the following purpose:

    "To promote and strengthen inter–membership trade, exchange of Melanesian cultures, traditions and values, sovereign equality, economic and technical cooperation between states and the alignment of policies in order to further MSG members’ shared goals of economic growth, sustainable development, good governance and security." (Art 2)

    "The parties affirm that democratization, development and the protection of fundamental freedoms and human rights and mutual reinforcing are interrelated. In addition thereto, the parties further affirm that, democratic principles are universally recognized principles underpinning the organization of the state to ensure the legitimacy of its authority, the legality of its actions reflected in its constitutional, legislative and regulatory system." (Art 5)

    "Respect for human rights, democratic principles and the rule of law shall underpin the domestic and international policies of the parties and constitute the essential elements of the contractual nature of the relations between the parties to this Agreement." (Art 6)

    It follows therefore that the ONLY LEGAL AGENDA, DELIBERATION AND RESOLUTION of the week long meet by the Melanesian Spearhead Group in Port Villa with Frank Bainimarama is as follows:

    • To Acknowledge that Frank Bainimarama and the Military Government is NOT the Legitimate Authority of the Republic of Fiji
    • To Express its grave concern for Frank Bainimarama's DISRESPECT for human rights and the rule of law in the Republic of Fiji
    • To Reiterate its international policy which constitutes THE essential element of their relations and expressed previously in its vote and membership within the Pacific Islands Forum.

    Anything contrary to the above three resolutions would be ultra vires i.e. Beyond their Powers.
